Nonprofit veteran service organizations (VSOs) exempt under federal tax code section 501(c)(19), such as the VFW, American Legion, and DAV, qualify for a Virginia sales and use tax exemption on purchases of tangible personal property used for their mission. Smaller VSOs with annual gross receipts under $5,000 also qualify.

Restrictions

Exemption does not cover purchases used primarily for social/recreational activities or insurance benefits for members. VSOs must apply and obtain a certificate of exemption from Virginia Department of Taxation. Does not apply to purchases for personal member benefit.
